Allahabad High Court in Kamlesh Kumar Nirankari vs. State of U.P. and Others (WA No. 20140/2023)on August 25, 2025, held that appointments obtained through forged or fraudulent documents are void ab initio and confer no legal right to continue in service or draw salary. Building upon this principle, the Court observed that when fraud vitiates an appointment, there is no requirement to initiate disciplinary proceedings before its cancellation, as such an appointment is non-est from inception. The Court further clarified that long years of service cannot legitimise an appointment tainted by forgery.
