Dismissal based on unverified documents in the inquiry is invalid: SC

The Supreme Court of India, in the case of JAI PRAKASH SAINI VERSUS MANAGING DIRECTOR U.P. COOPERATIVE FEDERATION LTD. & ORS. (2026 LiveLaw (SC) 315) held that documents relied upon in a departmental enquiry must be properly proved through witnesses if the employee does not admit them.

A Bench comprising Justice Sanjay Karol and Justice Manoj Misra observed that mere reliance on documentary evidence is insufficient unless such documents are formally proved and the employee is given an opportunity to challenge them.

The Court emphasised that when an employee denies the charges, the burden of proof lies squarely on the employer. It ruled that dismissal or punishment cannot be sustained based on unverified documents alone.

Delivering the judgment, the Bench stated that even in cases based entirely on documents, unless the relied-upon documents are admitted, a witness must be examined to prove those documents, and such witnesses must be available for cross-examination.

The ruling came while setting aside the dismissal of an employee of a cooperative federation in Uttar Pradesh. The Court rejected the employer’s argument that vague or evasive denial of charges amounted to admission, clarifying that denial cannot substitute proof.

Highlighting procedural fairness, the Court reiterated that departmental proceedings, though not strictly bound by the rules of evidence, must still adhere to basic principles of proof and fair hearing. This includes giving the charged employee a reasonable opportunity to contest evidence presented against them.

Legal experts note that the judgment strengthens safeguards in service jurisprudence by ensuring that disciplinary authorities cannot bypass evidentiary requirements. The decision is expected to have wide implications for disciplinary proceedings across government departments and public sector institutions, ensuring greater accountability and fairness in internal enquiries.
