Raj. HC in the case of Lal Chand Jindal vs. Regional Manager (S.B. CWP No. 1334/2015), recently ruled ruled that Sundays, and other paid holidays, must be included when calculating continuous service under the Industrial Disputes Act, 1948 (“ID Act“). The Court relied on the Supreme Court’s decision in Workmen of American Express International Banking Corporation vs. Management of American Express International Banking Corporation [AIR 1986 SC 458] and remanded the matter to the Tribunal for fresh consideration.
