Calcutta High Court in Shri C. Chitambaram vs. The Director of Transport (WPA 862/2022), directed the reinstatement of a casual worker who had been dismissed following allegations of diesel pilferage. The worker was acquitted in the criminal trial, and no internal inquiry was held. The Court emphasized that even casual or daily rated workers are entitled to reinstatement if termination is found to be illegal and not based on a fair process.
