Himachal Pradesh High Court in Rishi Raj vs. Ram Krishan and Ors. (FAO (MVA) No.4016 of 2013) on July 15, 2025held that a valid employer–employee relationship can exist between close family members, including real brothers, if supported by credible evidence. The Court noted that the employee was engaged by his brother as a Conductor-cum-Manager of a truck, and such engagement cannot be treated as gratuitous merely because of family ties. Emphasising that providing employment to an unemployed brother is a natural and lawful arrangement, the Court rejected the insurance company’s contention that no employment relationship existed and directed it to pay compensation.
