IC can not inquire into to complaint against the employer: Delhi HC

Delhi High Court in X vs. Akademi and Ors. (CM APPL. 47022/2023)  on August 28, 2025, held that the Secretary of an establishment heading a government-financed institution falls within the definition of “employer” under the PoSH Act. As a result, the Court clarified that any complaint of sexual harassment against him would lie only before the local committee, and the IC lacked the jurisdiction to inquire into such complaints. Since the probationary employee had filed the complaint before the IC, the Court held that the enquiry lacked legal basis. Consequently, the termination of her services during the pendency of the complaint was found to be vitiated by mala fides and violative of principles of natural justice.
