SC directs Labour Department to implement PoSH Act

Supreme Court,on August 12, 2025 while reviewing compliance with its earlier orders on implementation of the PoSH Act, reiterated the obligation of all employers to constitute ICs and underscored the corresponding duty of District Officers to monitor such compliance. In furtherance of this, the Court directed Chief Labour Commissioners and Labour Officers to support District Officers by collecting establishment data and reporting the same to Chief Secretaries, thereby ensuring the constitution of ICs and local committees across all establishments. The Court noted that several states had failed to conduct the mandatory survey and, to address this lapse, imposed a 6-week deadline for its completion. It cautioned that continued non-compliance would attract statutory penalties, including fines up to Rs. 50,000 and cancellation of licences or registration in the event of repeated violations. To strengthen enforcement, the Court further directed states to upload collected data onto the SHe-Box platform, thereby enabling centralised monitoring of compliance. The matter has been scheduled for further review on October 14, 2025, ensuring accountability of the states until full compliance is achieved.
