Balancing Compliance, Ethics, and Industrial Harmony in Contract Labour Management
The case examines the pitfalls and legal complications that arise from the prolonged use of temporary manpower without following statutory frameworks, especially the Contract Labour (Regulation & Abolition) Act, 1970. Set within a public sector organisation, the case explores the strategic decision-making process in response to an industrial dispute raised by long-serving contract labour. It emphasises HR's crucial role in resolving sensitive labour issues while safeguarding organisational integrity and reducing legal liabilities.

Background:

Since the early 1990s, a Central Public Sector Enterprise (ABC Ltd) engaged approximately 25 contract labour for non-core activities via direct, individual agreements. The practice continued until 2005, with the company ensuring wages, PF, ESI, and other statutory benefits.

In 2004, the corporate HQ issued guidelines mandating engagement only through registered contractors. Consequently, direct contracts were phased out, and labour were transitioned to third-party contractors. A protest followed but was managed peacefully.

The Dispute:

In 2010, 24 labour filed a writ petition seeking regularisation, later redirected to raise an Industrial Dispute. The dispute centered around the following contentions:

  • Employed since 1992, initially by ABC Ltd directly.
  • Received salaries and benefits directly until 2005.
